Need help getting a banned account back. Willing to pay.

Hello, I'm from Southern California and I'm very unfamiliar with IMVU. I've played it briefly twice a long time ago. However I have a close friend from Romania who is a level 6 pro creator, and she was banned for using an unauthorized version of IMVU's 3D Chat application. She denies this, and she is very distraught.

I'm doing all I can to try and help her get it back. I did a lot of googling and read similar cases where others were unfairly banned, and I came across this site where I read about filing a small claims court case against them. Problem is, I'm very clueless with IMVU and I'm not sure if I'm allowed to file it for her. Can anybody give me some advice or possibly assistance? I'm willing to pay via paypal if someone can help get it back. I also posted at IMVU's official forums explaining everything in detail, asking for the case to be escalated and I request speaking to a manager but they're not doing it. If anybody can help I would be very appreciative. Thank you.

If she hires you in some way shape or form, you could sue in small claims court on her behalf as a representative of her business: http://www.nolo.com/legal-encyclopedia/ ... er7-1.html

That, or if you own a business, you could try to claim her account as an asset.

If she provides you with proof of billing for the account, you could try claiming the account as your own.

I see.. so if she owns a business I can speak as a representative of her business. That seems a bit difficult, I'm a high school drop out and I don't know if I would be qualified to handle such a thing. I would do it though. Also she's a college student, and she create IMVU products as a hobby. I'm not sure if that could be considered a business. She's also from Romania.

I do have a ebay store, a paypal business account. and I am self employed. Is it against the ToS to take over somebody's account? I guess I could do that. I was reading that IMVU typically gives the account back before the schedule court date, so I was hoping I could just file a case, I'm terrified of actually having to appear in court. I don't know anything about IMVU.

Since you own a business, I would claim her as your employee and the IMVU account as a business asset.

As long as you can get the case filed, you should not have to show up to court. They do always cave before the court date. IMVU inc is all about making money, and it is cheaper for them to give back the account than it is for them to show up to court.

What a coincidence, I was just reading a older thread about this process and I was going to ask you something. In that thread you mention you seen someone from Europe doing it and it took about a month.

Is it possible that she can file the claim herself? I'm terrified of going into something that I'm completely clueless in. But I wouldn't mind to help assist her.

I just came back from Department of California Affairs website, reading info on how to file a complaint. And I read something about Mediation, and I tried contacting a mediator to see if they can step in. If I take them to court, do you think there's a possibility they might counter sue if I lose the case?

Thank you for the advice Don Von, it's giving me a lot of hope. And I read other posts from you as well. So the most important thing I should do is getting those papers filed and delivered, because from your knowledge IMVU always cave in before the court date so I won't actually have to worry about showing up. I think I might just try filing a complaint against them and claiming her as an employee.
